CUSTOM ORDER PROCESS & UPDATES


▪️ALL COMMUNICATION AND UPDATES WILL SENT VIA EMAIL FROM: INFO@JVITALIA.COM. ▪️ORDER PROCESS: All Design Consults and Finish Approvals Will Be Via Writing. For the purpose of guaranteeing appropriate information for both the client and JVD, Images & Videos will be sent to both the client and JVD. ▪️PREPPING The Most Important And Time-Consuming Stage, is the process After Sourcing (or The Locate), which is when the piece has been decided by the client. Colors and Handle Confirmation For Each Piece Need To Be Decided In This Stage In Order For The Piece To Move Towards The Restoration Stage. Clients Are Required To Complete A Color Selection Form For Each Piece. Images or videos Of Piece(s) Are Not Sent During This Stage ( They Are Sent Only In The Locate, confirmation of piece in the studio, And Final Painting Layers). ▪️HANDLE OR COLOR CHANGES As A Prerequisite to Prepping, Change Of Handle(s) And/or Color Needs To Be Decided Before The Restoration Process Begins. Any New Handles Must Be Received Before The Final Painting Process Begins. There is a flat Rate of $10.00 per Handle And Color Change And A $450.00 Back Labor and Time Fee for Any Handle Change Request After Painting Has Begun. An additional 4 Weeks Will Be Added To Production Time. ▪️ COLOR CHANGE REQUESTS A Color Change Request Form Will Need To Be Filled Out And Signed Before Proceeding On A Color Change. Once The Paint Finishing Has Begun Any Color Change Requests Will Be Billed At The Full Invoiced Restoration Cost With A One- Time Back-Labor and Time Fee Of $600.00. An additional 6 Additional Weeks Of Production Time Will Be Added For Color Changes. JVD Reserves The Right To Deny A Color Change Request. If A Color Change Request Is Denied The Piece Will Move Towards Completion Using The Paint Finish Originally Selected During The Design Consult. No Refunds Will Be Made If A Color Change Is Denied. ▪️ FINAL PAINT LAYERS A recap Final design consults may be and will be on a recorded meeting. With each first design consultation you will be required to complete a color finish selection approving the color palette. During the final paint layers you will receive images and finally a images & videos for approval.




MULTI  PIECE ORDERS


Multi-Piece Orders Are Not Worked On At The Same Time. All Orders Will Have A Contracted Production Time and work Will Begin On The Date Order They Are Received. Should A Client Want All The Pieces Sent Together, Order Will Not Be Available for Delivery Until the Last Production Order Completion Date on the contract. Multi-Piece Orders May require A Longer Waiting Time, And Clients Will Be Notified If Extra Time Is Needed. If Client Chooses To Have A Completed Piece Remain On Premises And Be Shipped With Their Other Pieces, A Storage Fee Of $75.00 Per Week Will Be Billed Until All Your Pieces Leave The Studio.




COVID DELAYS & PRODUCTION TIME, FORCE MAJEURE


COVID DELAYS: The COVID-19 pandemic has created many new challenges. Small businesses globally have been negatively affected with such disruptions as supply deficits, staff shortages, and exponential increases in shipping costs. JVD is no exception. For this reason, If NJ is again shut down because of a state of emergency, there will be a delay in the orders placed immediately before, during and closely after the shut down. This delay is a direct reflection of the shut down, not of JVD's lack of effort to meet the client's understood production time. IMPORTANT: Covid has caused significant delays in production & delivery time. Please keep this in mind when placing your in-stock or custom order requests. Production Time: The typical production time for pieces is 24 weeks, from the date of purchase. JVD makes all efforts to adhere to completing within this time frame. However, sometimes events outside our control occur that will translate into additional time needed to complete a piece. If this is the case, the client will be emailed notifying them of the extra time needed. Production Time Schedule: IN-STOCK PIECES: Up to 12 weeks after purchase ( Delivery must be arranged by client- please review the Delivery and Shipping section). CUSTOM ORDER: Up to 24 weeks ( Delivery must be arranged by client- lease review the Delivery and Shipping Section). IMPORTANT: This schedule DOES NOT include shipping time. Keep in mind that delivery companies are momentarily in high demand. FORCE MARJEURE JVD may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party that materially affects the performance of Services. Such occurences may include, but are not limited to: COVID and/or another pandemic, an act of God (fires, explosions, earthquakes, hurricane, natural disasters, flooding, storms or infestation), War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not), or any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.




DELIVERY &  SHIPPING


▪️Shipping Is Not Included in the Custom Order, in-stock furniture order or home decor items JVD is not a delivery company and does not have any affiliation nor receives compensation from any of the delivery companies used by clients. It has no control over pricing, delivery dates, time of delivery or damages that may occur during transit or delivery. Please be prepared for extensive delays and price increases caused by the pandemic. Requests to cancel due to shipping costs are not honored. If a client's delivery time exceeds the purpose of the furniture piece, a request to cancel can be approved and the client will receive store credit. Damages during transit must be reported directly to the delivery company. JVD can assist , if requested, with any support documents needed for resolution. ▪️SHIPPING SUGGESTIONS: The following are shipping platforms currently being used by clients: Uship.com Plycon J&R Express Trucking Uber Package Arrangements from other transporters are welcomed, as is client pick up. Because these are custom, one- of- a- kind pieces they CANNOT be shipped via: USPS, UPS, FED-EX, GREYHOUND, DHL. Items will not be released to these companies because shipment must be handled by a two-man hand carrier only. ▪️DELIVERY Client is responsible for communicating with delivery company for updates once furniture is picked up from JVD studio. If the client refuses the delivery, any fees associated with the delivery refusal is the sole responsibility of the client. The cost of returning the pieces to JVD will also be the responsibility of the client. Note: Spatial measurements for pieces are the responsibility of the client. Item specifications are provided to the client from the onset of the buying process. No refunds will be considered for pieces that do not fit into the client's desired space. ▪️FURNITURE RELEASE Full Balance Must Be Paid Before Any Furniture Pieces are Released. Balances past 90 Days after a custom order is completed will be considered abandonment/breach of contract, resulting in forfeiting of any payments made.No refunds, nor store credit will be made and the artwork and/or furniture pieces will become property ofJennifer Vitalia Design LLC. ▪️PICKING UP: Any pieces being dropped off or picked up must have an appointment to do so. Clients who choose to pick up will receive 20% off their order.




PAYMENTS, REFUNDS, CANCELS, DISPUTES OR CHARGEBACKS


▪️ PAYMENTS All Deposits Are Non-Refundable. All Sales Are Final.All Deposits, partial payments and full payments on custom orders are non-refundable. Payment On/Of A Custom Ordered Piece Nulls Any Rights To A File A Dispute On The Payment Transaction. Request To Cancel A Custom Order, For Any Reason, Including But Not Limited To Buyer's Remorse, Will Result In Forfeiting The Deposit And The Furniture Piece(s) Will Become The Property Of Jennifer Vitalia Design Llc. Please note that custom orders require a 70% retainer with remaining balance apportioned to a payment plan. At any time the remaining balance can be paid in full. There are no payment plans for orders under $1000.00. Late Payments will result in a weekly $75 charge ( In the event of a state shutdown, late fees will not apply during designated shutdown time). Balance must be paid in full before any piece is released to the client. Non-Payment Of The Balance Past 30 Days Upon Completion Will Be Considered Abandonment Breach Of Contract, resulting In forfeit of previous payments made and furniture piece (s) will become the property of Jennifer Vitalia Design LLC. ▪️CHARGEBACKS / DISPUTES JVD values its relationship with its clients and makes all efforts to provide desired products to clients within the typical production time framework. Project communication is regular to assureclient is up to date with all production information. Occasionally a client decides to dispute the order. These disputes and/or chargeback requests are considered unwarranted and are not honored by JVD. If a dispute or chargeback occurs, the client's account will be forwarded to the company's lawyer and/or collection agency and all contact with Jennifer Vitalia Design will cease. Any Chargeback Filed after A Piece Is Delivered will result in the client's account transferred to the company's attorney and a repossession process will be initiated to retrieve the JVD pieces specified in the chargeback. All fees accrued by JVD as a result of the the chargeback process, including legal fees and damages, will be considered the responsibility of the client and will be charged to the client. ▪️ IN-STOCK If you are not completely satisfied with your in-stock purchase, please contact us at: info@jvitalia.com within 7 days of receipt of the piece(s). Once JVD has received the item(s), it will be inspected for damages. If undamaged, you are eligible for an in-stock or custom exchange that does not exceed the purchase price of the item (s). Store credit can also be applied for the item purchase amount to be used within two years of the return receipt date. Any taxes charged will be refunded in accordance with applicable state laws. Jennifer Vitalia Design reserves the right to refuse returns or exchanges of items that are not in as-new condition due to damage or misuse by the client. ▪️CLIENT REQUEST TO CANCEL OR RESCHEDULE JVD values its client relationship and understands that sometimes there are life altering circumstances. If this is the case and client requests to cancel JVD Services, the Client shall provide immediate written notice JVD with a request for cancellation to include the reason for the request. The request will be reviewed by JVD with appropriate actions communicated with the client after review. Providing notice will not automatically translate to relieving the client of any currently outstanding payment obligations. JVD will not be obligated to refund any portion of monies Client has previously paid. Jennifer Vitalia Design has no obligation to attempt to re-book further Services to make up for Client’s cancellation or rescheduling.




STORAGE & LATE FEES


Once The Piece(s) Is Ready For Delivery There Is A 3 Week Courtesy Holding Time. After Three Weeks A Storage Fee Of $75.00 Per Week Will Be Charged. After 8 Weeks With No Pick Up Scheduled, All Rights To The Piece Will Be Forfeited, Considered Abandoned And No Refunds Will Be Made. In The Event Of A State Shutdown, The Late Fee Will Not Be Applied During The Weeks Or Months On Lockdown.




COPYRIGHTS


JVD does not allow the use of images and/or modifications, adaptions, tranlations or derivative JVD images to post, transmit or otherwise make available any materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others; (b) defamatory, libelous, fraudulent or otherwise tortious; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner. JVD does not allow reproduction, modification, adaption, translation, or creation of derivative works for sale. JVD does not allow removal of any copyright, trademark or other proprietary rights notice from the JVD. Any or all will be considered a copyright breach and information will be transferred to JVD's lawyer.




DEFAMATION / SLANDER / REVIEWS


Any Threats Or Actions Of Leaving A Bad Review In Order To Receive A Refund, Free Artwork Or Furniture, Extortion, Slander, Harassment, Or Illegal Practices Will Not Be Tolerated. JVD Will Not Hesitate To Proceed With The Proper Legal Action Immediately.




NON-DISPARAGEMENT


▪️NON-DISPARAGEMENT YOU ARE WAIVING YOUR FIRST AMENDMENT RIGHTS TO MAKE PUBLIC STATEMENTS REGARDING YOUR CLIENTS BY INCLUDING THIS PROVISION. THE LAW ALREADY AFFORDS REMEDIES FOR DEFAMATORY STATEMENTS AND THIS PROVISION MAY NOT BE LEGAL IN YOUR JURISDICTION. IF IT IS NOT LEGAL, AND SOMEONE CHALLENGES THIS PROVISION AT SOME POINT, THE SEVERABILITY CLAUSE WILL STRIKE IT FROM THE CONTRACT BUT LEAVE THE OTHER PROVISIONS INTACT]. The Parties mutually agree not to make public defamatory statements that would materially harm the reputation or business activities of any Parties to this Agreement. Client agrees to indemnify and hold harmless Contractor and its employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services provided herein. JVD takes pride in its work and works diligently to make sure that clients are satisfied. We treat all our clients with value and respect and expect the same in return. In the rare situation in which a client is dissatisfied will make every effort to reasonably work with the client. However, in the event of unsubstantiated disparagement of the side of the client, communication will cease immediately and the client's file will be forwarded to JVD's lawyer who will then represent JVD in all subsequent communication.




ONE-OF-A-KIND ARTISTIC FINISH & RELEASE


1- Variations Are Natural and Expected. Given their artistic custom finish, variations in the furniture pieces are to be expected. Because each piece is unique, these subtle differences are part of their individual character. For this reason no two items are exactly alike. Images reflected on any Websites and items presented for review to a client may vary. 2- Custom Orders Cannot Be Canceled Once Supplies Are Ordered Custom Orders Begin Production Immediately after the initial consultation. This consultation reviews your specificities; therefore, the uniqueness of the order belongs to you. Once we meet to review and confirm your custom artistic furniture order, cancellation or refunds are not available. Deposits are not refundable once the client has consulted with Jennifer Vitalia Designs (JVD) . Once the initial consultation is complete and the client agrees to the specificities of the order, The Item(s)/Order cannot be canceled, changed, returned or refunded at any time. 3- Vendor and Client Expectations Client has spent a satisfactory amount of time reviewing Jennifer Vitalia Designs work and has a reasonable expectation that Vendor will perform the Services in a similar manner and style unless otherwise specified in an client's individual agreement. Jennifer Vitalia Design will use reasonable efforts to ensure Client's desired services are produced in a style and manner consistent with Vendor's current portfolio and Vendor will try to incorporate any reasonable suggestion made by Client. However, client understands and agrees that: Every client is different, with different tastes, budgets, and needs. For this reason variations in pieces found for client's review will exist. Services are often subjective art and Vendor has a unique vision, with an ever-evolving style and technique Jennifer Vitalia Design will use its artistic judgment when providing Services to Client, which may not include strict adherence to Client’s suggestions. Although Jennifer Vitalia Design will use reasonable efforts to incorporate Client’s suggestions and preferences, when providing Client with the Services, Jennifer Vitalia Design will have final decision regarding the aesthetic judgment and artistic quality of the Services. Dissatisfaction with Jennifer Vitalia Designs aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned. If client believes the final piece has been considerably diverted for desired Service, client will state in writing specifically what needs to be adjusted and request those adjustments. Jennifer Vitalia Designs will make all reasonable efforts to act on that request with an understanding from the client that no other adjustments may be made if the client is dissatisfied with their own adjustments/changes. Under this request, the Client also understands that the piece will return to production and will follow typical phase production time.

Please feel free to send over any images, blueprints, via email. there will also be an intake form which has an upload files area. Please Note: The recordings are required to protect both the client and the vendor. During the recording all aspects reviewed are recorded; therefore, if there is a nebulous detail on either the side of the client or the vendor, the recording can be revisited to clear up any perceived discrepancies. Recording are standard procedure at Jennifer Vitalia Designs. It is the manner by which we guarantee that the finished product to be shipped is exactly what the client wants. For this reason, if you wish not to be recorded, we are unable to move forward with a transaction.

CAN I CANCEL A CUSTOM ORDER


If Needed, Yes. However, It Will Result In Forfeiting The Deposit, Any Payments Made, And The Furniture Piece(s) Will Become The Property Of Jennifer Vitalia Design. There Are No Refunds On Deposits, Partial Payments, Or Full Payments As This Is Custom Tailored To You From The Very Beginning.




Q: THE PIECE HAS BEEN LOCATED, HOW LONG TO HAVE IN THE STUDIO?


While Sourcing Your Piece We Pull From Across The Country And Can Import As Well For The Perfect Piece. Many Times With Approved Furniture There Is A Limited Amount Of Time To Purchase Before It Will Move To The Next Buyer. If This Is An Approved Piece, It Is Paid For And Secured. Some Of Our Sourcing Locations Have Certain Hours And Days Allowed For Picking Up Purchased Pieces Which Jennifer Vitalia Design Does Not Control. Cross Country Pick Ups Will Have A Longer Wait Time To Be Delivered Into The Studio. Once The Piece Is In The Studio, Confirmation Images Are Sent Over Via Email.




Q: I WOULD LIKE TO ADD MORE PIECES, IS IT TOO LATE?


Multi-Piece Orders Will Have A Different Production Time. Multo Orders Are Worked On From The Date Of Order. JVD Will Not Store Any Pieces That Are Ready To Be Delivered Without Charging Weekly Storage Fees.




Q: HOW WILL I GET UPDATED ABOUT MY PIECE?


Via Email. The Emails Will Update You On The Stages And Information Needed At Those Times: One (1) Email Will Be Sent For Each Of The Custom Order Process Will Be: Locating, Picking Up, Confirmation Of Piece In The Studio, Prepping, Final Paint Layers And & How To Set Up Delivery. The Email Used Is The Email You Provided When First Contacted, Please Check Spam Folders If Emails Are Not Found. Any Update Before The Final Paint Layers Email Is Received Will Be In The Preparing Stage, Nothing To Update Or Exciting, We Only Send One Email For Prepping And There May Be Weeks In Between Without An Update, This Is Normal, This Just Means It Has Not Moved Into The Final Layers Yet. When The Final Paint Layer Email Is Received That Is When It Gets Exciting Again!




Q: WHEN CAN WE DISCUSS COLORS


Colors Are Discussed During The First Design Intake And Color Request Forms. We will have a color recap at the final finish layers. If The Palette Changes Prior To Final Painting Layers, A New Color Change Request Must Be Completed And Signed, There Will Be No Charge If Changes Requests Are Made Prior To Painting.




Q: I WANT TO CHANGE THE COLOR PALETTE FROM THE ORIGINAL IDEA, IS THAT AN OPTION?


If Final Painting Has Begun, We Will Need To Restart, Which Will Result In More Time Needed And Extra Fees. Color Changes Will Need An Additional Six Weeks Of Production Time. A Color Change Request Form Will Need To Be Filled Out And Signed And A New Design Consult Will Be Needed. We Allow One Color Change After Painting Has Begun. Color Change Requests Once The Paint Finishing Has Begun Will Be Billed At The Full Invoiced Restoration Cost And A One Time Fee Of $600.00 For Back Labor Time. Jvd Reserves The Right To Deny The Request. If A Color Change Request Is Denied The Piece Will Move Forward Into Completion With The Last Signed Paint Color Change Request Form. No. Any Work Done By Jennifer Vitalia Design Is For Her Creativity, Ideas, Concept Intakes And Artistic Abilities. ▪️Shipping Is Not Included in the Custom Order, in-stock furniture order or home decor items JVD is not a delivery company and does not have any affiliation nor receives compensation from any of the delivery companies used by clients. It has no control over pricing, delivery dates, time of delivery or damages that may occur during transit or delivery. . Please be prepared for extensive delays and price increases caused by the pandemic. Requests to cancel due to shipping costs are not honored. If a client's delivery time exceeds the purpose of the furniture piece, a request to cancel can be approved and the client will receive store credit. Damages during transit must be reported directly to the delivery company. JVD can assist , if requested, with any support documents needed for resolution. ▪️SHIPPING SUGGESTIONS: The following are shipping platforms currently being used by clients: Uship.com Plycon J&R Express Trucking Arrangements from other transporters are welcomed, as is client pick up. Because these are custom, one- of- a -kind pieces they CANNOT be shipped via: USPS, UPS, FED-EX, GREYHOUND, DHL. Items will not be released to these companies because shipment must be handled by a two- man hand carrier only. ▪️DELIVERY Client is responsible for communicating with delivery company for updates once furniture is picked up from JVD studio. If the client refuses the delivery, any fees associated with the delivery refusal is the sole responsibility of the client. The cost of returning the pieces to JVD will also be the responsibility of the client. Note: Spatial measurements for pieces are the responsibility of the client.
